This report outlines the application made by Mr Ross Gandon to Vary the existing Premises Licence for this premises. The Licensing Sub-Committee must determine the outcome for the application.

The Licensing Specialist outlined the report with no additional information to be added and read out a representation received by a resident.

The applicant informed the sub-committee that the variation to the licence is to allow the venue to grow but not make it a nightclub as they wish to continue as a controlled small place, the variation would allow it to fit in with the various other establishments in the vicinity but they are well aware that it is also a residential area. He informed that they had received no complaints from local residents.

The Licensing Sub-Committee asked the applicant various questions, and the following points were discussed:

·         Windows and doors to be kept closed, albeit when hot

·         The applicant should note the comments made by the representation received

·         Sunday opening is not in line with other establishments – people move to other venues that stay open longer.

The Committee has taken into account, the Revised guidance issued under section 182 of the Licencing Act 2003, the Councils licencing policy the advice from the Police as well as Ms Goff’s representation.

The committee are satisfied that the minor deviation from the suggested opening hours contained in the Councils Policy statement will not undermine the four licencing objectives and that the conditions applied to the licence will further promote these objectives.

Resolved:

The committee has decided to grant the application with amendments, these being the following:

Extending Opening Hours until: 

Mon to Thursday – 11:00 - 23:30

Fri to Saturday – 11:00 - 00:30

Sundays – 11:00 -23:30

Plays, Films, Live music, recorded music, late night refreshments and the supply of alcohol on and off sales should follow the following times:

Monday to Thursday – 11:00 - 23:00

Friday to Saturday

 – 11:00 - 00:00

Sundays – 11:00 - 23:00

The two conditions being attached to the licence are:

• CCTV as per the Police advice.

·         The CCTV system shall continually record whilst the venue is open for licensable activities and / or when customers remain on the premises. All recordings shall be time & date stamped, maintained for a 31 day period and be made available to the Police or authorised officer of the licensing authority upon request. The CCTV system shall:

·         Cover all entry points used by the public.

·         Enable frontal identification of persons entering in any light condition.

·         Be maintained by a suitably qualified person

·         Sufficient competent persons should be authorised by the premises licence holder to provide the Police with downloaded CCTV data (footage and / or images) in an appropriate recorded when formally requested to do so.

·         The authorised person(s) should be sufficient to enable such data to be obtained by the police within 48 hours of a formal request being made.
